Terms & Conditions

Last updated: 23 August 2026

1. About these Terms & Conditions

These Terms & Conditions ("Terms") apply to services provided by Rob Dawson / You Better Coaching ("I", "me", "my", "You Better Coaching"), including online courses, leadership coaching, mentoring, health coaching and related services.

By purchasing or participating in a service provided by me, you agree to these Terms.

These Terms should be read together with my Privacy Policy.

Where a specific proposal, quotation, invoice or other written agreement contains terms that are different from these Terms, the specific written agreement will apply to the extent of any inconsistency.

2. About You Better Coaching

You Better Coaching is a coaching and training service operated by Rob Dawson.

The name "You Better Coaching" is used as the trading name under which I provide my coaching and training services.

Where applicable, invoicing and payment collection may be handled through Waipu Tree Care Ltd.

3. Services

You Better Coaching provides services that may include:

  • online leadership and professional development courses;

  • leadership coaching and mentoring;

  • group coaching;

  • individual coaching;

  • health and wellbeing coaching; and

  • workshops, training and related services.

The specific services included in a particular purchase will be described on the relevant sales page, proposal, quotation, invoice or other written agreement.

4. Online course

Where you purchase an online course, your purchase provides you with a personal, non-transferable licence to access and use the course materials for your own personal or professional development.

Unless otherwise stated, course access is provided for 12 months from the date of purchase.

Course access is provided through Teachable, which is the platform I use to deliver the course.

You must not:

  • share your login details with another person;

  • allow another person to access your course using your account;

  • copy, reproduce, distribute or sell the course materials;

  • upload or publish course materials elsewhere; or

  • use course materials to create or deliver your own competing course or training programme without my written permission.

All course content, including videos, written materials, workbooks, exercises, diagrams and other resources, remains my intellectual property unless otherwise stated.

5. Course pricing and payment

The current course packages are:

Course — $597 NZD

Payment is required in full before course access is provided.

Course + Group Coaching — $997 NZD

Payment may be made:

  • in full at $997 NZD; or

  • under an agreed payment plan of 2 monthly payments of $525 NZD, for a total of $1,050 NZD.

Course + Group Coaching + Individual Coaching — $2,197 NZD

Payment may be made:

  • in full at $2,197 NZD; or

  • under an agreed payment plan of 3 monthly payments of $775 NZD, for a total of $2,325 NZD.

Payment plans must be agreed with me before purchase and will be confirmed on the relevant invoice or other written agreement.

Payment is made separately from Teachable. Teachable is used to provide access to the online course and is not the payment processor for these purchases.

Where applicable, invoices will be issued through Waipu Tree Care Ltd and payments will be made to that business.

6. Payment plans

Where a payment plan has been agreed:

  • each payment is due on the date specified on the invoice or agreed payment schedule;

  • you remain responsible for all agreed payments;

  • course and/or coaching access may be suspended if a payment is overdue;

  • I may withhold or suspend further services until overdue payments are brought up to date; and

  • suspension of access does not automatically cancel your obligation to make payments already agreed.

I may agree to alternative payment arrangements at my discretion.

7. Refunds and cancellations

I do not generally offer voluntary refunds once access to an online course has been provided or coaching services have commenced.

However, nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand law.

If a service does not comply with a guarantee required by law, you may have rights to require the issue to be remedied or, depending on the circumstances, cancel the service and seek a refund or other remedy.

If you believe there is a problem with a service, please contact me as soon as reasonably possible so that I have an opportunity to address the issue.

Where a purchase is made by a business for business purposes, the parties may agree in writing to contract out of the Consumer Guarantees Act where legally permitted.

8. Group coaching

Where group coaching is included in a package:

  • each group coaching session is 1 hour;

  • the group sessions must be used within 6 months of purchase;

  • sessions will be scheduled and communicated to participants in advance;

  • group coaching is provided to participants collectively and is not individual coaching; and

  • the content and discussion of group sessions may vary according to the needs of the participants.

I may change the date or time of a group coaching session where reasonably necessary. Where I need to make such a change, I will provide reasonable notice and arrange an alternative session where appropriate.

9. Individual coaching

Where individual coaching sessions are included in a package:

  • sessions are arranged at mutually agreed times;

  • individual sessions must be used within 12 months of purchase;

  • each session is intended for the individual participant who purchased the package;

  • sessions cannot normally be transferred to another person; and

  • unused sessions expire at the end of the applicable 12-month period unless otherwise agreed in writing.

If you fail to attend a scheduled individual coaching session without providing at least 24 hours' notice, that session will be considered used.

Where you provide at least 24 hours' notice, I will make reasonable efforts to reschedule the session at a mutually suitable time.

I may waive the 24-hour requirement where exceptional circumstances make it unreasonable to apply it.

10. Coaching relationship

Coaching is a collaborative process. I will provide coaching, mentoring, education, reflection, questions, tools and other support intended to assist you in working towards your own goals.

Coaching does not guarantee any particular outcome.

Your results will depend on many factors, including your circumstances, decisions, actions and commitment to applying what you learn.

You remain responsible for your own decisions, actions and results.

11. Health and wellbeing coaching

Health and wellbeing coaching provided by You Better Coaching is intended to support education, behaviour change, goal setting, self-awareness and healthy lifestyle practices.

Health coaching is not medical care and is not intended to diagnose, treat, cure or prevent any medical condition.

I am not acting as your doctor, medical practitioner, psychologist, psychiatrist, dietitian or other regulated health professional unless expressly stated otherwise.

You should seek appropriate advice from your doctor or another suitably qualified health professional regarding medical conditions, medications, significant symptoms, injuries, mental health concerns, nutrition requirements or other matters requiring professional medical care.

You remain responsible for determining whether any exercise, dietary, lifestyle or other health-related change is appropriate for you.

If you have concerns about your health or experience significant or concerning symptoms, you should seek advice from an appropriately qualified health professional.

12. No guaranteed results

I do not guarantee that participation in a course, coaching programme, workshop or health coaching service will result in any particular personal, professional, business, leadership, financial, health or wellbeing outcome.

Any examples, testimonials or statements about possible outcomes are illustrative and should not be interpreted as a guarantee of your individual results.

13. Confidentiality

I will treat information you share with me during coaching or mentoring as confidential, subject to:

  • your permission to disclose it;

  • circumstances where disclosure is required or permitted by law;

  • circumstances where disclosure is reasonably necessary to protect someone's safety; or

  • information that is already publicly available.

Group coaching is different from individual coaching. While I will ask participants to respect the confidentiality of discussions within group sessions, I cannot guarantee that other participants will maintain confidentiality.

You should therefore use your discretion when sharing particularly sensitive personal or business information in a group setting.

14. Intellectual property

All intellectual property contained in my courses, coaching materials, workbooks, videos, exercises, presentations, documents, frameworks and other resources remains my property unless otherwise stated.

Your purchase gives you permission to use these materials for your own personal or professional development.

You may not reproduce, distribute, publish, sell, licence, modify or commercially exploit the materials without my prior written permission.

15. Website content

I make reasonable efforts to ensure that information published on the You Better Coaching website is accurate and current.

However, information on the website is provided for general information and may be updated or changed from time to time.

I do not guarantee that the website or all information on it will always be available, complete, accurate or free from errors.

16. Third-party services

I use third-party services to operate and deliver my business, including platforms such as Squarespace, Google Workspace and Teachable.

Those services are operated by independent providers and are subject to their own terms, policies and technical limitations.

I am not responsible for interruptions, outages or failures caused by third-party providers that are outside my reasonable control.

17. Website and course availability

I will make reasonable efforts to keep the website and online course available.

However, temporary interruptions may occur because of maintenance, technical problems, internet or telecommunications issues, or problems affecting third-party service providers.

Where reasonably possible, I will take steps to restore access as soon as practical.

18. Limitation of liability

To the maximum extent permitted by law, I will not be liable for indirect, consequential or incidental loss arising from your participation in my courses, coaching or other services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded, including rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand law.

19. Your responsibility

You are responsible for:

  • providing accurate information where required;

  • maintaining the security of your course login details;

  • attending coaching sessions at the agreed times;

  • completing agreed actions and exercises if you choose to do so;

  • making your own decisions about how you apply information provided through coaching or training; and

  • seeking appropriate professional advice where your circumstances require it.

20. Termination or suspension

I may suspend or terminate your access to a course or coaching programme if you:

  • fail to make required payments;

  • share your course access with another person;

  • copy, distribute or commercially exploit course materials without permission;

  • behave abusively, threateningly or inappropriately towards me or other participants; or

  • materially breach these Terms.

Where appropriate, I will give you reasonable notice and an opportunity to remedy a breach before taking action.

Termination or suspension does not affect rights or obligations that arose before termination.

21. Changes to services

I may make reasonable changes to the content, structure, delivery method or scheduling of my courses and coaching services.

I will take reasonable steps to ensure that any changes do not materially reduce the services you have purchased.

22. Force majeure

I will not be responsible for failure or delay in providing services where the failure or delay is caused by circumstances beyond my reasonable control.

This may include serious illness, natural disasters, severe weather, internet or telecommunications failures, platform outages, government restrictions or other events that could not reasonably have been prevented.

Where this occurs, I will take reasonable steps to resume or rearrange the affected services.

23. Privacy

Personal information is handled in accordance with my Privacy Policy.

My Privacy Policy explains what personal information I collect, how I use it, who I may share it with and your rights in relation to that information.

24. Complaints and concerns

If you have a concern about a service, please contact me as soon as reasonably possible.

I will make reasonable efforts to understand the issue and work with you towards an appropriate resolution.

Nothing in this section limits any rights you may have under New Zealand law.

25. Governing law

These Terms are governed by the laws of New Zealand.

Any dispute arising in relation to these Terms or the services provided by You Better Coaching will be subject to the applicable laws and courts of New Zealand.

26. Changes to these Terms

I may update these Terms from time to time to reflect changes to my services, business practices or applicable law.

The latest version will be published on my website and will show the date it was last updated.

For purchases made before an updated version takes effect, the version of the Terms that applied at the time of purchase will generally continue to apply to that purchase, unless otherwise required by law or agreed between us.
